Welcome to North and Finch ("North and Finch," "we," "us," or "our"). These Terms of Service ("Terms") explain how you may use our website, northandfinch.com (the "Site"), and how we work together when you place an order with us.

By browsing our Site, creating an account, or purchasing from us, you agree to these Terms and to our Privacy Policy (which is part of these Terms). If you do not agree, please do not use the Site.

ELIGIBILITY

  • 1.1 To shop with us and place orders, you must be at least 16 years old and able to enter into a binding contract in your area.
  • 1.2 By placing an order, you confirm that you are at least 16 and that you're using a valid debit or credit card or other accepted payment method.

WHO WE ARE

  • 2.1 North and Finch is an online destination for wallpaper, fine art prints, and frames curated to help your house feel more like home. Every piece is made to order just for you.
  • 2.2 Because our pieces are produced individually for each order, production begins shortly after your purchase is placed.

ACCOUNT CREATION AND SECURITY

  • 3.1 You can create an account on our Site to keep track of orders and enjoy a smoother checkout experience. You're responsible for keeping your login details safe and for anything that happens under your account.
  • 3.2 Please make sure your account information is accurate and up to date.
  • 3.3 We may suspend or close your account at our discretion if we suspect fraud, misuse, abusive behavior, or violation of these Terms.

ORDERS AND OUR ACCEPTANCE

  • 4.1 When you place an order, you're making an offer to purchase the products in your cart under these Terms. All orders are subject to availability and our acceptance.
  • 4.2 We may refuse or cancel an order, or limit quantities, for reasons including stock issues, suspected fraud, or errors in pricing or product information.
  • 4.3 If we cancel an order after payment is processed, we'll refund the amount you paid for the canceled items.

MADE-TO-ORDER PRODUCTS & ALL SALES FINAL

  • 5.1 Every wallpaper, sample, print, and frame we sell is made to order. Because of this, all sales are final.
  • 5.2 We do not accept returns, exchanges, or cancellations once an order is placed.
  • 5.3 If there's an issue with your order (for example, damage in transit, an incorrect item, or a quality concern), please contact us right away at info@northandfinch.com with your order number and photos so we can review and make it right where appropriate.

PRODUCT DETAILS, COLOR VARIATIONS & INSTALLATION

  • 6.1 We work hard to photograph and describe our products accurately, but colors may look different from screen to screen and in different lighting. Minor variations in color, scale, or print placement can happen and are not considered defects.
  • 6.2 Please note that your device's display may not perfectly match the final printed piece. We always recommend ordering samples if you'd like to see a design in your own space first.
  • 6.3 Installation of wallpaper and other products should follow best practices for peel-and-stick or other adhesive wallpaper and any instructions we provide. It's your responsibility to make sure your walls and surfaces are properly prepared, compatible, and suitable.
  • 6.4 North and Finch is not responsible for any damage to walls, surfaces, or property caused by installation, removal, or misuse of our products. We encourage you to do your own research or consult a professional installer if you're unsure.

PRICING, TAXES & PAYMENT

  • 7.1 All prices on the Site are in U.S. dollars and exclude applicable taxes, duties, and shipping costs. Any additional amounts will be shown at checkout.
  • 7.2 We may update prices and fees at any time, but changes will not affect orders that have already been placed.
  • 7.3 By completing checkout, you agree to pay the full amount shown, including any applicable taxes and shipping fees.
  • 7.4 We accept payment via Shop Pay, PayPal, Google Pay, Venmo, and major credit cards (including Visa, MasterCard, American Express, and Discover), as available at checkout.
  • 7.5 By providing payment details, you confirm that you are authorized to use that payment method and authorize us (and our payment partners) to charge the full order total.

SHIPPING, DELIVERY & RISK OF LOSS

  • 8.1 We currently ship within the United States and Canada.
  • 8.2 Shipping rates and estimated timelines are shown at checkout. These timeframes are estimates only and can be affected by production schedules, carrier delays, customs for Canadian orders, and other factors.
  • 8.3 Risk of loss and title pass to you when we hand your order to the shipping carrier. Once a package is marked "delivered" by the carrier, we are not responsible for lost, stolen, or damaged packages.
  • 8.4 If your order arrives damaged, please reach out to us promptly at info@northandfinch.com with photos and your order number so we can look into it with the carrier and explore options.

REVIEWS, PHOTOS & SOCIAL MEDIA (USER CONTENT)

  • 9.1 You may be able to leave reviews on our Site, and you may choose to tag or mention North and Finch on social media (together, "User Content").
  • 9.2 By posting User Content on our Site or tagging/mentioning North and Finch on social media, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, copy, adapt, publish, translate, create derivative works from, distribute, display, and share that content in any media, including reposts on social media and other marketing.
  • 9.3 You promise that you own or control the rights to any User Content you share and that our use of it will not violate the rights of anyone else.
  • 9.4 We may, but don't have to, monitor, edit, or remove User Content at our discretion.

OUR DESIGNS & INTELLECTUAL PROPERTY

  • 10.1 All artwork, wallpaper patterns, product imagery, logos, text, and other content on the Site are owned by or licensed to North and Finch and are protected by copyright, trademark, and other intellectual property laws.
  • 10.2 You may browse the Site and purchase products for personal, non-commercial use only.
  • 10.3 Absolutely no commercial use, resale, reproduction, modification, redistribution, or creation of derivative works from our artwork, wallpaper designs, prints, or other content is allowed without our prior written permission. No exceptions.
  • 10.4 Any unauthorized use of our designs or content may result in legal action.

EMAIL & SMS COMMUNICATIONS

  • 11.1 You can choose to receive marketing from us via email and/or SMS. Signing up is optional and not required to place an order.
  • 11.2 By opting in to SMS, you agree to receive recurring promotional and transactional messages at the phone number you provide. Message frequency may vary (typically 3–5 messages per month). Message and data rates may apply.
  • 11.3 You can opt out of SMS at any time by replying STOP to a message. You can unsubscribe from emails by clicking the unsubscribe link in any email.
  • 11.4 How we collect, use, and protect your contact information is described in our Privacy Policy.

  • 15.2 In all cases, our total liability to you for any claim related to these Terms, the Site, or our products will not exceed the amount you paid to us for the specific order involved.
  • 15.3 Some places do not allow limitations on certain types of damages, so these limits may not apply to you in those jurisdictions.

INDEMNITY

  • 16.1 You agree to defend, indemnify, and hold harmless North and Finch and our owners, directors, officers, employees, affiliates, agents, and suppliers from any claims, damages, losses, liabilities, and costs (including reasonable attorneys' fees) arising out of or related to:

  • (c) Your violation of the rights of any third party.

DISPUTES, GOVERNING LAW & WHERE CLAIMS ARE HANDLED

  • 17.3 Any legal actions or proceedings must be brought exclusively in the state or federal courts located in Utah, and you consent to the jurisdiction and venue of those courts.

IF PART OF THESE TERMS ISN'T ENFORCEABLE

  • 19.1 If any part of these Terms is found to be unlawful, void, or unenforceable, that part will be enforced to the fullest extent possible, and the rest of the Terms will stay in full force and effect.

THE ENTIRE AGREEMENT
